Cell Towers

The Madison County Planning Commission will consider again the construction of a cell tower on the top of Joe Lick Knob in southeastern Madison County on June 17 (6 pm). Boulevard Properties was denied a permit for this cell tower by the Madison County Planning Commission on May 20 by a 4 to 3 vote.

A provision inserted into the ’96 Telecommunications Act prevents local community planning groups from considering health issues.  The courts have generally upheld this provision in ruling that a community cannot reject a cell tower because of health concerns.
